By continuing to use Brilliant Air's services, you agree to these Terms and Conditions.

If you do not agree to the terms outlined below, we recommend that you do not use our services.

 

1. Introduction

Welcome to Brilliant Air. By using our services, you agree to the following terms and conditions. Please read them carefully. If you do not agree with any part of these terms, you should not use our services.

2. Services Provided

Brilliant Air provides HVAC (Heating, Ventilation, and Air Conditioning) and Refrigeration (HVAC&R) services, including but not limited to installation, maintenance, and repair. Our services are provided as described in the service agreement signed prior to the commencement of work.

3. Service Fees

Our fees are based on the services provided as detailed in the service agreement. Additional charges may apply for emergency services, parts replacement, or any additional work not specified in the initial agreement. Payment terms will be outlined in the service agreement and are due upon completion of the work unless otherwise specified.

4. Scheduling and Cancellations

Appointments will be scheduled at a mutually convenient time. We require at least 24 hours’ notice for cancellations or rescheduling. Failure to provide adequate notice may result in a cancellation fee.

5. Client Responsibilities

The client is responsible for providing access to the property and ensuring that all necessary preparations are made prior to our arrival. This includes securing any pets or valuables, clearing the work area, and ensuring proper water flow and valve positioning for condenser water systems.

6. Warranty and Guarantees

Brilliant Air warrants that our services will be performed with reasonable care and skill. We offer a warranty on parts and labor as specified in the service agreement. This warranty does not cover damage caused by misuse, neglect, or modifications made by the client. Any work related to Brilliant Air's quoted services carried out by parties other than Brilliant Air will void our warranty obligations.

7. Limitation of Liability

Brilliant Air shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to the performance of our services, including but not limited to loss of use, loss of revenue, or any other consequential damages.

8. Non-Liability Clause for Condenser Water Leaks

In residential apartment buildings, Brilliant Air does not assume responsibility for any water leaks or damage resulting from the operation of condenser units. The client acknowledges that condenser units are subject to operational conditions that may cause water leakage. It is the responsibility of the property owner or management to maintain and manage the building's infrastructure to handle any potential water discharge from such units.

9. Privacy and Data Protection

We respect your privacy and are committed to protecting your personal information. Any data collected during the course of providing our services will be used in accordance with our Privacy Policy.

10. Changes to Terms

Brilliant Air reserves the right to modify these terms and conditions at any time. Any changes will be posted on our website, and your continued use of our services will constitute acceptance of the revised terms.

11. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the jurisdiction in which Brilliant Air operates (QLD, Australia). Any disputes arising from or related to these terms will be subject to the exclusive jurisdiction of the courts in QLD, Australia.
